Waste disposal is the most critical of all environmental problems; most Local Authorities are under increasingly under immense pressure from their tax payers to tackle this issue. Waste can come from a variety of sources – household, agriculture, commerce, demolition and construction and covers litter and general refuse.
The Law is sometimes complex in this area. All businesses are required to dispose any waste generated from the business legally – by having a trade waste contract in place. Waste covers anything from paper, cardboard to general food waste. Any disposal on the Highway or by any other means is considered flytipping or unlawful disposal of waste and these types of offences can attract a maximum fine in the Magistrates’ Court of £5,000 for the less serious offence to £50,000 or imprisonment for the most serious breaches.
Two large companies – one a nuclear waste company and the other a large Indian restaurant were prosecuted in September 2010 by an East London Local Authority for leaving some bags of rubbish on the street outside their business premises, both Companies entered guilty plea to the offences and were fined £2,000.
